The Firm and Our Fees
We are happy to discuss
and negotiate fees and payment schedules. We need to be able to
afford each other. It is important that the business aspect of our
relationship be ironed out before beginning of our representation.
Many services can be priced on a fixed fee basis. Please ask.
We are a small, boutique firm located in San Francisco. Our primary focus is on
general counsel services, securities law business compliance, business and
commercial transactions, commercial litigation and patent prosecution. Our
size, focus and experience allow us to provide high quality legal services with
flexible and affordable fee arrangements. With regard to the latter, we use a
variety of arrangements designed to meet the client's budgetary requirements.
These arrangements, all which are detailed in the written fee agreement between
the firm and the client and made part of the representation agreement at the
onset of the relationship, include:
- Flat Fees – A fixed amount, agreed to in advance, for
the performance of specific legal services.
- Retainer –
Attractive to businesses for budget management purposes, a fixed monthly or
quarterly fee amount, typically at a reduced hourly rate, for a certain amount
of consultation time or specific services over the retainer period.
Rate – Hourly rates vary based on the complexity of the matter and are
billed in 1/10th hourly increments via detailed time records. Our rates currently vary from $295 to $475 per hour.
- Contingent Fees – Typically utilized
for litigation matters where a successful outcome of the dispute resolution
provide the means and obligation for payment of fees. Court costs and related
out-of-pocket expenses are advanced by the client. In some cases, a
non-refundable suit fee may also be required.
Participation – Used In certain business start-up or financing situations, the
legal fee is paid either in cash or equity based on a successful outcome.
– We have used combinations of the above arrangements based on the client’s
budgetary constraints. We like this one.
